Overview

This website, simmsknitting.com, is operated by Simms Knits ("Simms Knits", "we", "us" or "our"). By visiting the site or buying from us, you agree to these Terms of Service and to the policies they reference, including our Refund Policy, Shipping Policy and Privacy Policy. If you don't agree, please don't use the site.

The store is hosted on Shopify. Payments may be processed by third-party payment providers, whose own terms also apply to the payment.

1. Using the site

You must be at least the age of majority where you live to place an order. You agree not to use the site for any unlawful purpose, to interfere with its security or operation, to upload malicious code, or to collect other users' information.

2. Products and descriptions

We try to describe and photograph every product accurately, including fiber content, measurements and colours. Colours can look different on different screens, knitwear varies slightly from piece to piece, and hand-knit items are individually made, so small differences in stitch, colour placement and size are expected. Measurements are approximate.

We may limit quantities, discontinue products or change descriptions at any time.

3. Prices and orders

Prices are in US dollars and may change without notice. Placing an order is an offer to buy; we accept it when we ship it. We may refuse or cancel any order, for example if an item is unavailable, if the price or description was shown in error, or if we suspect fraud. If we cancel an order after you've paid, we refund you in full.

Discount codes have their own conditions, can't be exchanged for cash and may be withdrawn at any time.

4. Payment

You agree to give current, complete and accurate purchase and account information, and to keep it up to date. Payment details are handled by our payment providers and are not stored by Simms Knits.

5. Shipping, returns and refunds

Shipping times, costs and the areas we deliver to are set out in our Shipping Policy. Returns and refunds are covered by our Refund Policy. Risk of loss passes to you when the order is delivered to the carrier-confirmed address.

6. Accounts

If you create an account, you're responsible for keeping your login secure and for activity under your account. Tell us at support@simmsknitting.com if you think your account has been misused.

7. Content and intellectual property

All site content, including text, photographs, graphics, logos and the Simms Knits name, belongs to Simms Knits or its licensors and is protected by law. You may not copy, reproduce or reuse it without our written permission.

If you send us reviews, comments or ideas, you give us a non-exclusive, royalty-free right to use, edit and publish them. You confirm that what you send doesn't infringe anyone's rights and isn't unlawful or offensive.

8. Third-party links and tools

The site may link to or use third-party services. We don't control them and aren't responsible for their content or practices. Your use of them is at your own risk and subject to their terms.

9. Disclaimer

The site and products are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the site will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent the law allows, Simms Knits and its owners, staff and suppliers are not liable for any indirect, incidental, special or consequential damages arising from your use of the site or products. Our total liability for any claim relating to a product is limited to the amount you paid for that product.

11. Indemnification

You agree to indemnify and hold Simms Knits harmless from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the site.

12. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Hillsborough County, Florida.

13. Changes

We may update these Terms at any time by posting the new version on this page. Continuing to use the site after a change means you accept it.
